Terms & Conditions
These terms govern your use of this website and any session voucher or offering you purchase through it.
This website is operated by Marco Wang Photography ("we," "us," "our"), based in Houston, Texas. By using www.marcowang.com or purchasing through it, you agree to these terms. If you do not agree, please do not use the site.
Wedding and other commissioned work is governed by the separate written contract you sign with us. Where that contract and these terms differ, your signed contract controls.
Purchases and Payment
Prices are shown in US dollars. Texas sales tax is calculated and added at checkout where it applies. Payment is processed by Stripe; we do not receive or store your full card number.
A purchase is complete when your payment succeeds and you receive a confirmation by email. We reserve the right to decline or cancel an order — for example, if a price is listed in error or a payment cannot be verified — and will refund you in full if we do.
Session Vouchers
A session voucher entitles the holder to one portrait session as described on the product at the time of purchase. Unless stated otherwise, this means a one-hour on-location session with at least 50 edited images delivered.
- Vouchers are non-refundable. Once purchased, we do not provide cash refunds.
- Vouchers are transferable. You may gift or transfer your voucher to someone else. Tell us the recipient's name and email so we can update our records.
- Vouchers are valid for one year from the date of purchase and must be redeemed for a session that takes place within that period.
- After expiration, the voucher itself lapses, but we will credit the amount you paid toward a session booked at our then-current rates. You are responsible for any difference in price.
- Vouchers have no cash value, cannot be redeemed for cash, and cannot be combined with other offers unless we say so in writing.
Add-on services purchased alongside a voucher, such as on-site styling, follow the same terms and are subject to the availability of the person providing them.
Scheduling, Rescheduling and Cancellation
Sessions are booked through our scheduling page, subject to availability. Dates are not held until they are confirmed.
You may reschedule once at no charge with at least 48 hours' notice before your session start time. Rescheduling requests made less than 48 hours in advance, and no-shows, forfeit the session and the voucher is considered redeemed. We apply this to protect time that has been reserved and can no longer be filled.
If we must cancel or reschedule — for illness, equipment failure, or another cause on our side — we will offer you the next mutually available date. If we cannot deliver the session at all, we will refund what you paid for it. This is the limit of our liability for a cancelled session.
Weather, traffic, and other conditions outside anyone's control may require a change of location or time. We will work with you to find a reasonable alternative; these circumstances are not treated as a cancellation by either party.
Travel
Sessions taking place more than 15 miles from ZIP code 77008 are subject to a travel fee, quoted before your session is confirmed. Destination and international work is quoted separately.
Delivery of Images
Finished images are delivered through a password-protected online gallery. We will tell you the expected delivery timeline when your session is booked. Galleries remain available for a limited period, so please download and back up your images promptly. We archive files according to our standard practice but do not guarantee that they will be retained indefinitely.
The number of delivered images is as described on the product. Selection, editing, and final creative decisions are ours. We do not provide unedited or raw files.
Copyright and Use of Images
We retain the copyright in all photographs we create. On delivery, you receive a personal, non-commercial license to use your images: you may print them, share them, and post them on your personal social media accounts. Please do not crop out or edit over our work, apply filters, or use the images commercially without our written permission.
Unless your contract says otherwise, we may use images from your session in our portfolio, on this website, on social media, in print, and in submissions to publications. If you would prefer we did not, tell us in writing at info@marcowang.com and we will honor that going forward. See our Privacy Policy for more.
Your Conduct During a Session
We ask for basic courtesy and cooperation so that the session can be completed safely and on time. We reserve the right to end a session early if anyone present behaves abusively, unsafely, or unlawfully, or if a location becomes unsafe. In that event the session is considered delivered and no refund is due.
Website Content
All photographs, text, and design on this site are our property or used with permission, and are protected by copyright. You may view and share links to our pages. You may not reproduce, republish, or use our images for your own purposes without written permission.
We aim to keep the site accurate and available but do not guarantee that it will be error-free or uninterrupted. Pricing and offerings may change at any time; the terms that apply to your purchase are those shown at the time you buy.
Limitation of Liability
To the fullest extent permitted by law, our total liability arising out of any session, purchase, or use of this site is limited to the amount you paid us for the service in question. We are not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited by law.
Disputes and Governing Law
These terms are governed by the laws of the State of Texas. Any dispute will be brought in the state or federal courts located in Harris County, Texas.
If something goes wrong, please contact us first at info@marcowang.com. Nearly everything can be resolved with a conversation, and we would rather have that conversation than a dispute with your card issuer.
Changes to These Terms
We may update these terms as our business changes. The date at the top reflects the most recent revision. The version in effect when you make a purchase is the version that applies to it.
